General Terms and Conditions (GTC)

Hotel Waldhaus am See – St. Moritz, Switzerland

1. Scope and Conclusion of Contract

These General Terms and Conditions (GTC) apply to all contracts for accommodation and all other services and deliveries provided by Hotel Waldhaus am See to guests. The accommodation contract is concluded once the hotel has confirmed the guest’s room booking in writing (by email or booking confirmation). Verbal and telephone commitments become valid only when confirmed in text form by the hotel.

2. Services, Prices, and Payments

The hotel undertakes to provide the services booked by the guest and confirmed by the hotel. All prices are stated in Swiss Francs (CHF) and include statutory VAT. Price changes remain expressly reserved until the contract is concluded.The hotel may, at its discretion, request an advance payment; the amount and due date of the deposit will be communicated to the guest in the reservation confirmation. If an agreed deposit is not paid on time, the hotel may withdraw from the contract after issuing a reminder and granting a reasonable grace period—claims for damages by the hotel remain reserved.Unless otherwise agreed, the total invoice amount must be paid by the guest upon arrival (by credit card, debit card, or cash). Payment on invoice after departure is not permitted. Accepted credit cards and other payment methods are listed in the booking confirmation.

 

3. Check-in and Check-out

On the day of arrival, the reserved room is available to the guest from 2:00 PM. Check-in is generally possible between 2:00 PM and 10:00 PM.

For arrivals after 10:00 PM, the guest is required to inform the hotel in advance; otherwise, the hotel reserves the right to reallocate the room. On the day of departure, the room must be vacated and returned to the hotel by 12:00 noon at the latest.

Check-out is possible from 7:30 AM. Late check-out requires prior approval from the hotel; without approval, the hotel may charge 50% of the room rate for departures after 12:00 noon and 100% of the full room rate for departures after 6:00 PM.

The guest has the right to provide proof that the hotel has suffered no or significantly lower damages.

4. Cancellation Policy and No-Show

Cancellations must be made in writing (by email or letter) to the hotel. Unless otherwise specified in the reservation confirmation, the following cancellation conditions apply based on the strictest policies of comparable establishments in St. Moritz:

  • Free Cancellation: Cancellations made at least 30 days before the arrival date are free of charge (especially for high-season stays, e.g., Christmas/New Year).
  • Late Cancellation: For cancellations made later than 30 days before arrival, the hotel charges 100% of the agreed arrangement price as a cancellation fee. The same applies to early departures or no-shows, in which case the full amount for the booked stay is due.
  • Non-Refundable Rates: Special non-cancellable/non-refundable offers cannot be canceled or modified after booking. Such bookings require 100% prepayment at the time of reservation. In case of cancellation or no-show, the full prepayment amount is retained as compensation, and no refund is available.

The hotel reserves the right to define individual cancellation conditions in the reservation confirmation for special rates or group bookings. Guests are advised to carefully review the information on their respective booking confirmation.

5. Hotel Liability

The hotel is liable within the framework of legal provisions for its own contractual obligations with the care of a prudent businessman. However, the hotel assumes no liability for theft, loss, or damage to items brought by guests to the extent permitted by law. This includes clothing in the wardrobe, valuables in the room or room safe, storage of sports equipment (e.g., in the ski room), as well as vehicles or items in the hotel parking lot or underground garage. The hotel expressly disclaims any liability for compensation in these cases.

Guests are advised to either personally secure valuables or deposit them in the hotel safe at the reception. Storage in the in-room safe is at the guest’s own risk.

The hotel is not responsible for vehicles or their contents parked in the underground garage or on the parking lot. Parking is at the guest’s own risk. The hotel explicitly excludes liability for damages to vehicles caused by third parties (damage, break-in, theft).

The hotel does not accept liability for minor property damage. In cases of personal injury or damage caused by gross negligence or intent on the part of the hotel, statutory liability regulations apply. The hotel is not liable for service deficiencies or failures resulting from force majeure or official orders.

6. Guest Liability

The guest is liable to the hotel for damages or losses caused by themselves, their travel companions, guests, or accompanying persons. The guest is also responsible for damages resulting from misuse or improper use of hotel facilities. This includes excessive cleaning costs (e.g., severe contamination or smoking in non-smoking rooms) and unauthorized opening of security devices (e.g., emergency exits without an emergency).The hotel reserves the right to charge guests for such damages or expenses, and the guest is obliged to provide immediate compensation.

7. Pets

Dogs are welcome at Hotel Waldhaus am See, but other pets cannot be accommodated.

Guests traveling with a dog must inform the hotel at the time of reservation or in advance of arrival. A maximum of one dog per room is allowed (multiple dogs upon request). The guest is responsible for ensuring that their pet does not disturb other guests or soil hotel areas. Dogs must be kept on a leash in public hotel areas (lobby, hallways). Pets are not allowed on furniture or beds, and guests must bring their own blankets or baskets for their pets. Any damage caused by pets or necessary special cleaning will be charged at cost.Other pets (especially cats) are not permitted.

The hotel reserves the right to request an early departure from guests who violate these rules, with the full arrangement price remaining due.

8. Wellness Area, Restaurant, and Events

The hotel offers its guests a small wellness area with sauna, steam bath, whirlpool and relaxation zone flightbridge.com. Access to the wellness area is by reservation only to avoid overcrowding. Use is at your own risk. flightbridge.com

Use of the wellness facilities is at the guest’s own risk. For safety reasons, children and young people under the age of 16 may only use the wellness area if accompanied by an adult. The guest must observe the posted rules of use (e.g. with regard to clothing, showering, hygiene and maximum number of persons). The hotel is not liable for accidents or injuries in the wellness area, unless they are due to the hotel’s fault. Massages or other treatments by external therapists can be booked at reception; these services are subject to separate agreements with the provider and the hotel only acts as an intermediary in this respect.

The hotel restaurant and bar are available to guests during the announced opening hours. Hotel guests can use the restaurant without prior reservation; table reservations are recommended, especially during peak times. Consumption in the restaurant or at the bar can be added to the room bill and must be settled on check-out at the latest. It is not permitted to bring your own food or drinks into the public restaurant areas and consume them there (with the exception of baby food or certain dietary products by prior arrangement). In the restaurant and at the hotel’s whisky bar, the largest in the world (over 2,500 whiskies), the instructions of the staff must be observed; in particular, we reserve the right to refuse to serve alcoholic beverages to persons who are obviously intoxicated. Guests under the age of 16 are not permitted in the bar and guests under the age of 18 are not permitted to consume alcohol.

For functions and events at the hotel (e.g. seminars, banquets, private parties or whisky tastings organized by the hotel), the respective agreements or special contractual conditions shall also apply. If a guest or organizer wishes to use hotel premises for an event, a separate reservation stating the type of event, number of participants, duration, etc. is required. The hotel will provide the appropriate rooms and technical equipment as far as possible, but accepts no liability for the success or failure of an event planned by the guest. Cancellations of booked events must be made in writing in good time; unless otherwise stipulated in the event contract, the cancellation conditions stated under point 4 apply analogously. The hotel may withdraw from the contract for an event if force majeure or other circumstances for which the hotel is not responsible make fulfillment impossible, or if the event threatens to jeopardize the smooth operation, safety or reputation of the hotel. In such cases, no claims for damages may be made against the hotel. In the case of events organized by us, the hotel reserves the right to change the program and prices. If an event offered by the hotel (such as a guided tour, theme evening, etc.) has to be canceled due to a lack of participants or for other reasons, the hotel will inform the registered guests as soon as possible and refund any fees already paid in full. There are no further claims.

9. Data Protection

The hotel treats guests‘ personal data confidentially in accordance with applicable data protection laws. Personal data collected during the reservation process is used exclusively for contract fulfillment and customer care and will not be disclosed to third parties without explicit consent. 10. Final Provisions

Amendments or additions to the contract, the inquiry or these GTC should be made in writing for verification purposes. Unilateral amendments or additions by the guest are invalid. Should individual provisions of these GTC be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid substitute provision that comes as close as possible to the economic purpose of the invalid provision. The same applies to any contractual loopholes.

Swiss law is agreed as the applicable law. The place of jurisdiction for all disputes arising from the contractual relationship is – as far as legally permissible – St. Moritz, Canton Graubünden, Switzerland.

11. Private Events

Private events in the wine cellar or whisky bar are possible for a minimum of 6 people. A flat fee of CHF 150.– applies, with a minimum turnover of CHF 500.–. Events in separate rooms require prior reservation and agreement.

Events in the Lake View Lounge can be booked for a rental fee of CHF 1,500 plus consumption during the mid-season, or for CHF 3,000 plus consumption during the high season.
